By placing an order with us you are agreeing to accept the following terms and conditions of sale.

Prices

We offer goods for sale through, our website www.techniqual.co.uk. Our prices vary from time to time and the website will be updated accordingly. All prices shown are exclusive of VAT. VAT will be added to the sale at the time you checkout online, at a rate of 20%. Prices do not include delivery. The cost of delivery will depend on the total weight of the order and will be calculated accordingly and will show in your basket prior to placing an order and making payment to us. Delivery is free to mainland UK for orders weighing over 250KG and for all other orders the maximum charge is £40+VAT.

Payment

All of our goods are offered to you on a payment with order basis unless specific terms have been otherwise agreed in writing. Your order will be processed upon receipt of payment. All goods remain the property of TechniQual Engineering Limited until such payment is received by us. Contact information from the customer details forms is used to verify user by email identification. By accepting these terms and conditions, you are also giving permission for TechniQual Engineering Limited to use your contact details to inform you of future offers, products or services. We will not share your data with any third party unless this is to enable an order to reach you. You are able to ask us to remove your data from our system at any time. Buyers are responsible for ensuring that they have appropriate skills, experience and knowledge in using the items that they have purchased from us. TechniQual Engineering accept no responsibility for any injuries, accidents, near-misses or deaths caused by misuse of any equipment purchased from us. Buyers must also read the user instructions (below) supplied by TechniQual Engineering prior to use. By accepting these terms and conditions buyers are confirming that they and/or any other user has read and understood the user instructions below and is experienced and competent enough to safely use the equipment. They also confirm that the buyer and/or any other users are aged 18 years or over.

Delivery

We will deliver your order to any mainland UK address. Our standard delivery uses a national carrier or on larger items a pallet delivery company. In most cases you will receive your goods within 5 working days. For delivery to addresses in remote areas or away from the mainland, this can take a little longer.

If you require the items urgently, then please contact us via telephone or email to discuss. Availability of a quicker delivery option depends on where you are and in some cases the time of day. This will be confirmed with you at the time you place your order. We use a third-party delivery company, therefore, we accept no liability for delivery delays beyond our control.

Receiving Orders

Upon receipt of the order, the person placing the order (the buyer) is responsible for checking for accuracy and condition of the goods supplied. The buyer must report any issues to TechniQual Engineering by telephone within 24 hours of receiving the order. Failure to do so may result in us not accepting any returns or replacing items. We always require an authorised signature when delivering goods to you. We will not be held responsible for non-delivery due to lack of signature.

Availability

TechniQual Engineering is a distributor of goods. We aim to work with the manufacturer to ensure sufficient stock is available to fulfil all orders, however on occasions due to unexpected high demand, we may unfortunately run out of stock items. If this does happen your order may be delayed whilst we replenish stock. We will contact you as soon as possible to inform you of any delays. You may contact us at any time to check on the progress of your order.

Cancellation & Warranty

If you wish to cancel your order you may do so at any time until we dispatch it. Your order will be packed and dispatched quickly so any cancellations must be done via telephone. Unfortunately, we are unable to cancel any orders that have already been dispatched. Please note, chain slings are bespoke manufactured items and therefore, can only be returned if they have a manufacturing fault.

If any of the goods we supply fails to perform satisfactorily, please contact us via telephone to report. A return can be arranged and one of our trained engineers will carry out a thorough inspection and examination to identify any faults. If a manufacturing fault is found, then we will arrange to repair the item wherever possible. Where this is not possible, we will arrange for a replacement to be issued to you.

TechniQual Engineering Limited will not accept any liability for any faults that occur through misuse or through any actions that the buyer (and their representatives, staff, associates or any other person authorised to use the equipment by the buyer) has undertaken that is likely to impact upon the performance of the equipment or stored it in a place that may do so.

Force Majeure

TechniQual Engineering Limited accepts no liability for failure to supply goods under this Agreement due to a force majeure event. For the purposes of this agreement, a force majeure event means an event beyond the reasonable control of TechniQual Engineering Limited and includes but is not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of the Supplier or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors. Where a force majeure event occurs and TechniQual Engineering Limited are unable to supply the goods requested by the buyer, a full refund will be given to the buyer.

Liability

Nothing in these terms and conditions is intended to affect your statutory rights or to limit our liability for death, personal injury or fraudulent misrepresentation resulting from our negligence. If there is a problem, you may receive a refund or replacement under the terms of our Guarantee. Our liability to you will always be limited to a full refund of the goods purchased. We will not compensate for delivery delays or failures unless you have requested a premium delivery option. In these circumstances our liability to you will be limited to a refund of the delivery charges you have paid. Our liability to you specifically excludes compensation for indirect or consequential loss or damage however it arises and except as described above will always be limited to a refund of your payment.

English Law

These terms of business will be interpreted and adjudicated under English law.
